The disabled woman’s family has filed a lawsuit against the Walt Disney Group accusing Disneyland employees of making fun of her after falling on a Disneyland jungle cruise – she died five months later.

The family of Joanna Aguilar, 66, of Ventura County, filed a wrongful death lawsuit against Disney alleging she broke her leg in an August 2021 incident and died in January 2022 of complications, the Southern California newsgroup reported this week. .

According to Disney’s official website, the jungle cruise is a theme park tour along the river. Earlier this month, the lawsuit was brought before U.S. District Judge Cormac Carney at the Santa Ana Courthouse, according to local news.

Aguilar’s daughters, Andrea Mallul and Zenobia Hernandez, accompanied her to Disneyland on August 22, 2021 and helped her board the boat. But when she tried to get off the boat, they had trouble getting her up “small loose blocks on top of the existing steps inside the boat,” the reports said.

The lawsuit alleges that their mother fell and broke her hip, while Disneyland employees made fun of the woman.

“Leaving the boat was more difficult as she had to push her body up with her shin, which was not possible due to her disability,” the lawsuit, filed in November, said, according to SCNG. “The fight was obvious and the Disney cast started giggling. [sic] and giggled as they watched Ms. Aguilar try to get off the boat safely.”

Aguilar was taken to an Anaheim hospital for surgery to repair his injury. She stayed there for 10 days after the fall, then went to a rehabilitation center for five months. But Aguilar eventually went into septic shock due to the infection and died on January 29, SCNG reports.

In the lawsuit, the family claimed that Disneyland violated the Americans with Disabilities Act when they told Aguilar, who was physically disabled, that a wheelchair-accessible jungle cruise boat was not available.

A month after the lawsuit was filed, on Dec. 29, Disney’s lawyers denied the allegations in a written statement and said the company is seeking a jury trial, AP News reported.

Aguilar’s family is seeking monetary compensation for pain, mental anguish, humiliation, medical expenses and funeral expenses, the statement said.
