In a filing Friday in Washington federal court, Capitol Police General Counsel Thomas DiBiase said police learned from a Feb. 20 media report that Carlson’s employees were viewing thousands of hours of footage from the day of the riot that had not been released to the public. while.

DiBiase said he was told that “the Tucker Carlson show staff were allowed to view any footage they wanted under the supervision of the CHA staff, but that no footage was physically handed over to the show.”

He said that in the following weeks he had “numerous conversations” with the committee’s director of personnel, asking him to review every clip that would be made public.

This month, Carlson showed dozens of clips on his Fox News show. On his show, he said, “We take security seriously, so we first consulted with the Capitol Police before airing any of these videos. We are pleased to report that the reservations were minor and for the most part they were reasonable. In the end, the only change we made was to blur out the details of the only interior door in the Capitol building.”

In a statement, DiBiase said that of the many clips that aired on the Carlson show on March 6 and 7, he was only shown one clip before it aired.

DiBiase said the clip was from a list of places that were designated “confidential” and he approved of its use.

“The other 40 or so clips that are not on the X-Files List have never been shown to me or to anyone else in the Capitol Police,” DiBiase said.

Representatives for Fox News and the House Administration Committee did not immediately respond to requests for comment.

Using video clips, one segment by Carlson showed rioters walking through the Capitol without causing any damage or committing any act of violence. The host said that most of the rioters were peaceful “tourists” and not “rebels”.

The segment was criticized by lawmakers on both sides of the aisle as misleading. More than 900 people have been arrested in connection with the attack on January 6, 2021, in which about 140 officers were injured.

In a letter to Capitol police obtained by NBC News, agency chief Thomas Munger said Carlson’s report was “offensive.”

“The program has carefully selected the quietest moments of our 41,000-hour video,” Munger wrote. “The commentary does not provide context for the chaos and violence that occurred before or during these less intense moments.”

Speaker of the House Kevin McCarthy, D-Calif., said he agreed to share the video with Carlson as an “exclusive.”

DiBiase’s application was filed in the January 6 case by a defendant named William Pope, who said he believed the videos could include footage that could help exonerate him.
