Jan. 28 (UPI) — Jan. 6 rioter Julian Hather, who sprayed a mace in the face of late Capitol police officer Brian Siknick and others during the uprising, was sentenced to 80 months in prison.

US District Court Judge Thomas Hogan published in sentence — along with a $10,000 fine and $2,000 in damages — on Friday in Washington, D.C., dismissing Hater’s claim that his “crippling anxiety” problems made him less than entirely responsible for his actions.

prosecutors requested prison term of 90 months.

Hater was convicted in September after pleading guilty to ten counts, including assault, resisting or obstructing the use of dangerous weapons by certain officers, in connection with the January 6 attack on the Capitol by a mob of supporters of former President Donald Trump.

The government claimed that Hater’s “first victim” during the riot was Siknik, who died from multiple strokes hours after the attack. According to them, Siknik, who was guarding a police barricade on the Lower West Terrace of the Capitol, was sprayed in the face by Khater at close range of about 5 to 10 feet.

After he regained his sight after the attack, the police line on the Lower West Terrace was breached and the rioters entered the Capitol. He later responded to the call of shots in the chamber of the House of Representatives.

Siknik continued on duty at the Capitol until he began to slur and eventually passed out. He was taken to the George Washington University Hospital, where he remained on life support for nearly 24 hours. He was declared dead at 20:51 on January 7, 2021.

Hater’s co-defendant, George Tanios, received a five-month sentence from Hogan on Friday after pleading guilty to buying and carrying the poison spray Hater used during the attack.

Although it was accepted that Siknik’s death was due to natural causes, family members stated in the victims’ statements that it was clear to them that he died as a result of the 6 January uprising.

His mother, Gladys Siknik, told Hater, “You are at the center of our recurring nightmare.

“You, among all the other crazy people, are the cause of Brian’s death, Mr. Hater,” she wrote.

She wrote that the rioters who broke into the Capitol that day “regardless of whether they were charged with crimes … all of you are responsible for the death of Brian. All of you are responsible for the injuries inflicted on Brian’s colleagues – broken bones, traumatic brain injury and ongoing mental anguish that they suffer – and will endure – for the rest of their lives.
