EU woman jailed for trying to steal $2,000 worth of unpaid merchandise from Walmart

February 6 – EAU CLAIRE. A Wapak woman was sentenced to three days in jail for participating in an attempt to walk away with over $2,000 worth of unpaid merchandise from an Eau Claire Walmart store.

According to police, among the goods were crossbow arrows and broadswords, a baby stroller and a television.

Jade A. Weber-Marshak, 25, said on Monday she was dropping her challenge to the changed count of retail theft in Eau Claire County Court. She was initially charged with retail theft.

The count of bail evasion was dismissed but reviewed by Judge John Theisen at sentencing.

Weber-Marshak was also required to pay legal costs.

The Weber-Marshak dossier will be deleted after payment of legal fees.

Her co-defendant, 22-year-old Justin L. Tolle of Eau Claire, had previously been convicted.

According to the criminal case:

Police officers were sent to Walmart on Saturday, August 7, 2021 with a report of more than $2,000 worth of merchandise being stolen from the store.

The suspects were detained by officers, but soon fled. The suspects provided employees with fictitious names before fleeing the store, but employees identified their vehicle.

One officer stopped the suspects at a bus stop and identified them as Tolle and Weber-Marshak.

Walmart employees said the suspects walked past the last outlet with a cart full of merchandise and were contacted at the entrance to the store’s grocery section.

Weber-Marshak told police that she was at the garden center and was trying to enter through the door when she was contacted by employees. She said she gave a fake name because she got scared.

Weber-Marshak said she and Tolle fled the store when they were told law enforcement had been contacted.

Tolle told police that Walmart employees contacted them when they left the store with a shopping cart. He said he didn’t know how they were going to pay for the goods. He said that he thought Weber-Marshak would be able to pay for the things, but he didn’t know where she would get the money from.

Tolle and Weber-Marshak were both released on bail on pending felonies in Waupaka County. The state of bonds did not allow them to commit new crimes.
