Elizabeth Holmes bought plane ticket to Mexico after conviction, prosecutors say

Federal prosecutors have said in court documents that Elizabeth Holmes is at risk of escaping and should not be allowed to remain out of jail while she appeals her 11-year prison sentence for defrauding investors.

Holmes was booked on a one-way plane ticket to Mexico for Jan. 26, 2022, three weeks after he was convicted by a jury of four counts of fraud and conspiracy, federal prosecutors filed Thursday in a federal court said in a motion Northern California.

Holmes, who was Theranos’ CEO during the company’s turbulent 15-year history, was convicted of a scheme that revolved around the company’s claims to develop a medical device that could detect a variety of diseases and conditions from a few drops of blood. But the technology never worked and the claims were false.

Holmes booked a flight for 2022 with no scheduled return flight and only canceled it after prosecutors contacted Holmes’ lawyers about the “unauthorized flight,” prosecutors said.

Lawyers for Holmes did not immediately respond to emails and phone messages from the Associated Press on Friday. In an email dated January 23, 2022, responding to prosecutors’ concerns about the planned trip, they said Holmes booked it ahead of the jury verdict to attend a wedding in Mexico.

“Given the verdict, she does not plan to travel and therefore did not notify, request permission or request access to her passport (which the government has) to travel,” wrote Lance Wade, one of Holmes’ lawyers.

On November 17, U.S. District Judge Edward Davila sentenced Homes to more than 11 years in prison. Davila ordered the pregnant Holmes to report to prison on April 27, which gave her enough time to give birth to her second child before she went to jail. She gave birth to a son shortly before the start of the trial last year.

Prosecutors did not challenge Davila’s decision to give Holmes five months of freedom, nor did they mention the fact that they considered her an abscond.

Holmes is due back in court on March 17 for a hearing on her request not to leave jail while she appeals her sentence.
