DA requires OPD to seize funds

January 18th. The Ector County District Attorney’s Office has asked Ector County Judges to award the Odessa Police Department more than $10,000 seized by its officers during recent drug arrests.

According to court documents filed Tuesday, the seized money was used or intended to be used in the commission of a felony and is therefore subject to forfeiture under the Texas Criminal Procedure Code.

Documents show that $7,698 was confiscated from Dominic Adrian Gutierrez on January 3rd. Just over $1,000 was seized from Gerardo Ignacio Rojas on January 5, and $1,936 from Detaeveon Detron Warren on January 3.

According to OPD records, detectives investigating Harvey Gutierrez in connection with the murder of Maurice Rogers on December 28 found a safe in his son Dominic Gutierrez’s bedroom containing xanax, cocaine and marijuana. In the attic, detectives found two more safes with Xanax, cocaine, psilocybin or “magic mushrooms” and cocaine. They also found evidence linking Dominic Gutierrez to the safes.

In total, detectives seized more than 519 grams of cocaine and arrested Dominique Gutierrez on suspicion of possession of between 200 and 400 grams of a controlled substance, a felony of the first degree.

Harvey Gutierrez was arrested on suspicion of murder in the Rogers case, he also faces drug and child sexual abuse charges.

OPD records show that Rojas was arrested after police found 4.9 grams of M30 pills and a small amount of marijuana during a traffic stop, and Rojas admitted they were his.

Warren was arrested on suspicion of making/delivering a controlled substance after officers found electronic pens containing THC and marijuana in his motel room, and he admitted to selling the pens for $40 each, OPD records show. The judge later determined that the officers did not have sufficient evidence to arrest Warren and he was released from custody.
