Court of Appeal Denies Appeal by State Prisoner Who Wanted TV Back

January 22. Television was a bargaining chip as the reason a state inmate pleaded guilty to a goof punching a corrections officer at a state correctional facility in Dallas.

When the television was not returned, the prisoner wanted to withdraw his confession.

The Pennsylvania Supreme Court has denied an appeal by Andrew Nathaniel Bingham, 38, who wanted to withdraw his guilty plea to aggravated assault charges for punching a corrections officer on November 19, 2019.

State Police in Wilkes-Barre says in court records that two corrections officers accompanied Bingham to a misconduct hearing. Bingham freed his right hand from the handcuffs and punched a corrections officer in the head, court records say.

Bingham was pinned against a wall and wrestled with two guards before being handcuffed again.

Two correctional officers were injured.

Bingham pleaded guilty to aggravated assault, believing he would get the TV back. When the TV was not returned, Bingham wanted to withdraw his guilty plea.

On December 16, 2021, Lucerne County Judge David W. Lupas denied Bingham’s request for a state prison sentence of 30 months to five years.

Bingham appealed to the Supreme Court.

Last week, a three-member Supreme Court bench rejected Bingham’s appeal.

“Bingham’s written plea agreement does not mention at all that his television will be returned as a condition of his plea. Both the Commonwealth and the trial court stressed to him that the trial court had no authority to govern the (Pennsylvania) Department. Corrections to get Bingham’s TV back to him while he was still serving his prison term,” the appeals court wrote in its rebuttal.

Bingham is serving a prison sentence for burglary in Chester County.
